These Terms of Service ("Terms") govern your use of the Scope-Scan.AI mobile app and the scope-scan.ai website (together, "the Service") provided by English Optics ("we," "us," "our"), the Missouri-based operator of the Scope-Scan.AI product line.

You must be at least 18 years old and legally able to enter into a contract. The Service is a professional tool intended for property inspectors, contractors, renovators, and similar professional users.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us at support@scope-scan.ai immediately if you believe your account has been compromised.
You are responsible for the accuracy of the information you provide (email, address, etc.). If you provide false information, we may suspend or terminate your account.
This is important. By using the Service to capture a scan of a property, you represent and warrant that:
You — not English Optics or Scope-Scan.AI — are solely responsible for ensuring you have the right to scan a property and for any consequences of scanning without proper authorization. If a claim, lawsuit, complaint, or legal demand is made against you or against us because of a scan you conducted, you agree that you are responsible for defending it and for any resulting damages, and you agree to indemnify us (see Section 11 below).
Do not use the Service to scan properties you have no right to be at, to surveil people without consent, or for any illegal or invasive purpose. We reserve the right to terminate accounts and cooperate with law enforcement in response to reports of misuse.
You may not use the Service to:
We may suspend or terminate accounts for any of the above.
If you subscribe to a paid tier, you agree to pay the subscription fees disclosed at signup. Subscriptions renew automatically until you cancel. Cancellation is effective at the end of the current billing period; we do not provide prorated refunds for partial periods except where required by law.
Prices may change; if we change prices, we will notify you in advance and give you the opportunity to cancel before the new price takes effect.
If a payment fails, we may suspend your access to paid features until payment is resolved. Free-tier features may continue to be available.
By using the free tier of the Service (Geo Scans), you agree that the scan data — including photos, GPS coordinates, address, and room labels — may be used to train and improve our AI models, as described in our Privacy Policy. This is the trade for free access to the Service. If you are not comfortable with this, use the paid tier instead.
We own the Service, the software, the AI models, the underlying methods and techniques used to process scans and generate reports, and all related intellectual property (including trademarks, copyrights, trade secrets, and patents or patent applications). We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose while your account is in good standing. That license ends when your account ends.
The methods, algorithms, workflows, and user interface designs used by Scope-Scan.AI are proprietary to English Optics. Use of the Service does not grant you any rights in the underlying methods or technology. Any unauthorized use, replication, or reverse engineering of these proprietary methods is prohibited.
You retain ownership of the scans you upload. You grant us the licenses described in the Privacy Policy (to store, process, generate reports from, and — for free-tier scans — train our AI models on that data). Our license to use Paid tier scan data ends when you delete your account, subject to the retention periods described in Section 6 of our Privacy Policy. For Free tier scans, the license to use the data as part of our AI training corpus is perpetual and survives account deletion, as expressly disclosed in Section 6 of these Terms and Section 3 of the Privacy Policy.
The scope-of-work reports, measurements, cost estimates, and other outputs of the Service are generated by AI models based on the scans you provide. They are estimates and starting points, not professional advice or guarantees. You should verify all information with qualified professionals (contractors, inspectors, engineers, appraisers, etc.) before relying on it for financial, legal, or safety decisions.
We do not guarantee that reports are complete, accurate, up to date, or fit for any particular purpose. Use of any report is at your own risk.
The Service is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim all warranties, express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent allowed by law, English Optics and Scope-Scan.AI are not liable for:
This applies to claims under any legal theory (contract, tort, negligence, strict liability, or other). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless English Optics, Scope-Scan.AI, and our officers, employees, contractors, and attorneys from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Service, or your relationship with us (collectively, "Disputes") shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, rather than in court, except as specifically provided below.
The arbitration will be conducted by a single arbitrator. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
The arbitration will take place in Jackson County, Missouri, and will be governed by the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.) and, to the extent state law applies, by the laws of the State of Missouri, without regard to conflict-of-laws principles.
For any Dispute where the amount in controversy is less than $10,000, we will pay the initial AAA filing fee for arbitration if you have first tried in good faith to resolve the Dispute with us informally by contacting support@scope-scan.ai. Each party bears its own attorneys' fees unless the arbitrator awards otherwise under applicable law.
YOU AND WE AGREE THAT ANY DISPUTE MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding. If this specific class action waiver is found to be unenforceable, then the entirety of this Section 12 shall be null and void, but the rest of these Terms — including Section 13 (Venue) — shall remain in full effect.
Notwithstanding the above:
You may opt out of this arbitration agreement by sending written notice to R. Gregory Gore, Law Office of R. Gregory Gore, 605 SW US 40 Highway, PMB 319, Blue Springs, Missouri 64014 within 30 days of the date you first accepted these Terms (or, for existing users, within 30 days of the date these Terms are updated). Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.
These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
For any Dispute not subject to arbitration under Section 12 — including without limitation actions to enforce arbitration awards, actions for injunctive relief, and actions permitted under the carve-outs in Section 12 — you and we agree that the exclusive venue shall be the state or federal courts located in Jackson County, Missouri. You and we consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum, lack of personal jurisdiction, or venue.
This venue selection is a material part of these Terms. You agree that the venue selection is reasonable, that Jackson County, Missouri has a substantial relationship to English Optics and this agreement, and that you have received value (including free-tier access to the Service and/or paid subscription features) in exchange for agreeing to this venue.
By using the Service on behalf of another person, company, or entity, or by otherwise accepting these Terms in a representative capacity, you agree that the represented person or entity is also bound by Sections 12 and 13, including the arbitration agreement, class action waiver, and venue selection.
You may stop using the Service and delete your account at any time by emailing support@scope-scan.ai.
We may suspend or terminate your account at any time if:
On termination, your access ends; your data is handled as described in the Privacy Policy and on our Account Deletion page. Sections 6, 7, 8, 9, 10, 11, 12, 13, and 16 survive termination.
We may update these Terms. If we make material changes, we will update the "Last updated" date and, if the changes are significant, notify you by email or in the app. Continued use of the Service after changes means you accept the updated Terms.
